​EHC plans must be reviewed annually by the Local Authority. The purpose of the review is to consider the child or young persons progress towards achieving outcomes specified in the EHC plan. The review should include full involvement of the parent, child or young person and consider their views, wishes and feelings especially when making decisions.

Relevant legislation:

  • Regulations 2, 18, 19, 20, and 21 of the SEND Regulations 2014

NEW UPDATE: The COVID-19 outbreak introduced the Coronavirus Act 2020, with implications on the delivery of  provision across education and social care. Timescales which applied to Annual Reviews (see relevant legislation above) have been relaxed in changes introduced in the Special Educational Needs and Disability (Coronavirus) (Amendment) Regulations 2020.

The changes are in force until 25 September 2020.

What do these changes mean for you?

Annual Reviews still need to happen but Regulation 11 of the Special Educational Needs and Disability (Coronavirus) (Amendment) Regulations 2020 makes it possible for a delay if ''because of a reason relating to the incidence or transmission of coronavirus.'' and where this applies, ''a local authority must instead conduct such reviews as soon as reasonably practicable.”

How can we help?

Due to social distancing measures as a result of the COVID-19 outbreak, Annual Review meetings are being carried out remotely via online technology. We can join you remotely during an Annual Review meeting.

 

Reviews typically last up to 2 hours. At the meeting we advocate on your behalf ensuring that you are fully involved in the process, that your views as a parent or guardian are heard and on record. 

Notes will be taken of what is discussed and actions agreed. A full written record will be sent to you with next steps on the Annual Review process.
